Introduction and Acceptance of Terms
These Terms & Conditions (“Terms”) govern your access to and use of the websites, online stores and services operated by Hilson Creek General Trading LLC (“Hilson Creek”, “we”, “us” or “our”), including our MAQURE and Herbero brands and any current or future Hilson Creek brand (together, the “Website”).
By accessing the Website, creating an account, placing an order or otherwise using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or place an order.
These Terms should be read together with our Privacy Policy, which explains how we collect, use and protect personal data.

Eligibility and Use of the Website
There is no minimum age restriction to purchase from the Website. However, by placing an order you confirm that you have the legal capacity under applicable law to enter into a binding contract, or that you are purchasing with the involvement or consent of a parent or legal guardian where required.
You agree to provide accurate, current and complete information when creating an account or placing an order, and to keep your account information up to date.
Products, Pricing and Availability
We currently sell and ship products across the GCC. We may expand our service area to additional countries in the future, and these Terms will apply to any such expansion unless updated.
All prices displayed on the Website are shown in UAE Dirhams (AED) and are inclusive of applicable VAT, unless stated otherwise.
We take reasonable care to ensure that product descriptions, images and prices are accurate. However, errors may occasionally occur. If we discover a pricing or listing error after you place an order, we will contact you before proceeding and you will have the option to confirm the order at the correct price or cancel it for a full refund.
Product availability is not guaranteed until an order is confirmed. We reserve the right to limit quantities, discontinue products or modify product offerings at any time.
Orders, Acceptance and Payment
Placing an order through the Website constitutes an offer to purchase. An order is only accepted, and a binding contract formed, once we confirm the order (for example, by order confirmation email or equivalent notification).
We reserve the right to refuse, cancel or limit any order at our discretion, including in cases of suspected fraud, pricing or stock errors, unauthorised or illegal activity, or where required by law.
Payment
Payments are processed through third-party payment gateways, acquiring banks or payment service providers. The specific provider available to you may vary and will be identified at checkout. Card and payment details are entered into and processed within the payment provider’s own secure environment, and their use is subject to the payment provider’s own terms and privacy practices.
Full payment (or, where applicable, the agreed instalment or pay-later amount through an approved provider) is required at the time of placing an order unless otherwise stated at checkout.
Delivery and Shipping
Delivery timeframes vary depending on the delivery destination and distance from our fulfilment location, and estimated timeframes will be indicated at checkout or in your order confirmation. These timeframes are estimates and not guaranteed delivery dates.
Delivery fees are applicable and will be shown at checkout before you complete your order.
Risk of loss or damage to products in transit remains with Hilson Creek until the order is delivered to you or your nominated recipient. If your order is lost or damaged in transit, please contact customer support and we will arrange a replacement or refund.
Delivery fees are non-refundable in connection with standard returns (that is, returns made for reasons other than our error, such as a change of mind), even where the underlying product price is refunded.
Order Cancellation
You may cancel an order free of charge at any time before it is dispatched. Once an order’s status changes from “Processing” to “Dispatched/Shipped” that is, once a shipping label has been generated and scanned by the courier the order can no longer be cancelled.
If cancellation is no longer possible, you may still be able to return the item once delivered, subject to the Returns, Refunds and Warranty section below.
We reserve the right to cancel any order prior to dispatch, including for reasons such as stock unavailability, suspected fraud or pricing errors, in which case any payment made will be refunded in full.
Returns, Refunds and Warranty
Returns
We offer a strict 14-day return window, calculated from the date of delivery. To be eligible for a return, the item must be completely unopened and unused, in its original packaging with all seals, tags and accessories intact. Items that have been opened, used, or that show signs of wear will not be accepted for return.
To initiate a return, contact us at care@hilsoncreekglobal.com within the 14-day window with your order details and reason for return.
Refunds
Approved refunds will be issued to your original payment method. Please allow a reasonable processing time for the refund to reflect, depending on your bank or payment provider. Delivery fees are non-refundable for standard returns, as set out in Section 6.
Warranty
Products are covered by Hilson Creek’s own warranty terms, details of which are provided with the relevant product or on request. Our warranty covers defects in materials or workmanship under normal use and does not cover damage caused by misuse, unauthorised repair, normal wear and tear, or use inconsistent with the product’s intended purpose. To make a warranty claim, contact care@hilsoncreekglobal.com with your order details, a description of the issue and, where possible, supporting photographs.
Accounts and Guest Checkout
You may place an order either by creating an account or as a guest. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at care@hilsoncreekglobal.com if you suspect any unauthorised use of your account.
We reserve the right to suspend or terminate an account at our discretion, including where these Terms are breached or where fraudulent, abusive or unlawful activity is suspected.
Prohibited Use
When using the Website, you agree not to:
- Use the Website for any unlawful purpose or in violation of these Terms;
- Place fraudulent orders or provide false, inaccurate or misleading information;
- Purchase products for unauthorised resale or commercial redistribution without our prior written consent;
- Scrape, data-mine, reverse engineer or use automated means to access, copy or extract content from the Website;
- Interfere with, disrupt or attempt to gain unauthorised access to the Website, its systems, servers or networks;
- Introduce viruses, malware or other harmful code to the Website;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Infringe the intellectual property, privacy or other rights of Hilson Creek or any third party.
We reserve the right to refuse service, cancel orders, suspend accounts and take appropriate action, including legal action, in response to prohibited use.
Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, product images, brand names (including Hilson Creek, MAQURE and Herbero), designs, software and layout, is owned by Hilson Creek General Trading LLC or its licensors and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Website without our prior written consent. Nothing in these Terms grants you any right or licence to use our trademarks, brand names or content, other than as necessary to use the Website for its intended purpose.
Limitation of Liability
To the fullest extent permitted by applicable law, Hilson Creek shall not be liable for any indirect, incidental, special or consequential loss or damage arising out of or in connection with your use of the Website or purchase of products, including loss of profits, revenue, data or business opportunity.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death, personal injury caused by negligence, or fraud. Subject to the foregoing, our total liability to you in connection with an order shall not exceed the amount paid by you for that order.
Indemnity
You agree to indemnify and hold Hilson Creek, its officers, employees and agents harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website.
Third-Party Links and Services
The Website may contain links to third-party websites, payment pages, courier tracking pages or services that we do not control. We are not responsible for the content, accuracy or practices of third-party sites, and your use of them is subject to their own terms and privacy notices.
Force Majeure
We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, courier or logistics disruption, labour disputes, or other events of force majeure.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, services, brands, legal or regulatory requirements. The revised Terms will be published on the Website with an updated date. Continued use of the Website after changes take effect constitutes acceptance of the revised Terms.
